The sun is up in Europe! After so many years of preparing and waiting, the EU patent package has finally come into effect: Since June 1, 2023, legal actions are filed at the European Unified Patent Court (UPC), and unitary effect extending to 17 countries can be applied for whenever a new EP patent is granted.

It seems that many Japanese companies have taken a wait-and-see approach, opting out their entire portfolios or large parts thereof. However, European and US competitors are using the new system actively, and it will be important to understand the strategies and mechanisms of the new system well, to gain a competitive advantage and avoid unpleasant surprises.

We will look into the changes through the new system as an integral part of the talks during this conference, and of course we will also look into the recent changes and landmark decisions of the EPO and the case law of national courts.

In the U.S. there are several decisions of the Supreme Court of particular interest. We will analyse the impact of these decisions and other recent case law developments and trends for the IP strategies and practice of Japanese companies.

On the first seminar day (November 7) we will focus on issues of interest for all industries and update you on the latest political and legal developments in Europe and the US.

The morning of the second day (November 8) will be dedicated to new developments in the field of life science IP, where, as you will see, AI-related inventions become also increasingly relevant. The afternoon of the second day will focus on high tech issues, shedding light in very specific aspects of AI applications and very recent issues such as generative AI and nano systems.

As in the past years, in addition to comparative views of the situation in the US and Europe, expert comments from a Japanese perspective will be provided.

Simultaneous interpretation into Japanese will be provided throughout both days.

On the evening of the first seminar day, we are happy to invite all seminar participants to our CPPC Reception at the Roppongi Hills Club (51st floor). We truly look forward to this chance to meet you in person again, after years of the pandemic.

長年にわたる準備期間を経て、欧州特許パッケージがついに発効しました。新たなヨーロッパの日の出です。2023年6月1日以降、法的手続きは欧州統一特許裁判所（UPC）で扱われ、新たなEP特許の付与ごとに、17カ国で通用する単一効の申請をすることができます。

多くの日本企業は、ポートフォリオ全体またはその大部分をオプトアウトし、当面様子見の姿勢をとっているようです。一方で、欧米の競合他社は、新制度を積極的に利用しようとしています。このため、競争力で優位に立ち、予期せぬ不利な出来事を避けるためには、新制度の仕組みをよく理解することが重要になります。

当セミナーでは、この新制度がもたらす変化に焦点を置きつつ、欧州特許庁での最近の変化や重要な決定、また、国内裁判所の判例についても講演を行います。

また、米国では、注目すべき最高裁判決がいくつかありました。これらの判決をはじめ、最近の判例や傾向がが日本企業の知財戦略や実務に与える影響を解説します。

セミナー1日目（11月7日）には、あらゆる産業にとって関心の高い問題に焦点を当て、欧米における最新の政治・法動向をお伝えします。

2日目（11月8日）の午前の部では、ライフサイエンス分野における知財の新たな動きを取り上げます。午後の部では、ハイテク問題に焦点を当て、AI応用の具体的な側面や、生成AIやナノシステムといった最近の問題に注目します。

例年と同様に、セミナーでは欧米の比較的見地からのレクチャーに加え、日本の視点からの専門家のコメントも入ります。

両日を通じて講演には日英の同時通訳をご用意しております。

なお、11月7日には、セミナー後にレセプションディナー（会場：51階六本木ヒルズクラブ）をご用意しております。多くの皆さまのご参加をお待ちしております。
